No they are not protected but you can't trap nuisance wildlife without a trapping license and a nuisance wildlife trapping license just saying

From the NYS DEC website.

"Relocating an Animal
It is illegal for you to move or relocate an animal off your property. You cannot live trap an animal and release it in a park, on State land or anywhere other than on the property where it was captured. If you need a wild animal removed from your property, contact a Nuisance Wildlife Control Operator (NWCO). Relocating an animal can create problems for neighbors, can move diseases like rabies or Lyme, and can cause unnecessary stress to the animal. This task must be handled by a licensed professional."

So......there's the REAL answer.

I just finished relocating a family of red squirrels . All 5 of them went to a local park. Now I feel I can just get that chipmunk...... :-\

I don't think you need a trapping license to  live trap a  woodchuck under your shed   plus  you really don't want to shoot chucks  this time of the year they have  babies ..... good luck mac .....if all else fails  just name them

Well depending on his location and local ordinance, seems like the state would rather you shoot them, like how it is here in Maine. No closer season or limit on varmints, and pest control laws like that seem just a PC way of saying it.
