And excerpt from an article in the BN today -

"First, people questioned why golfing was an essential business. Now people are wondering why it's not.

Gov. Andrew M. Cuomo's latest revision of Covid-19-related business rules deems golf a nonessential enterprise. Public and private golf courses were required to close Thursday, per the governor's New York State PAUSE executive order.

Also Thursday, the governor deemed boat launches and marinas for recreational vessels nonessential."

Marinas are required to close, but they can apply to keep their launches open. DEC launches remain open according to a letter from Doug Stange of the DEC. It was in response to a letter from the Secretary of the Erie County Federation of Sportsmen's Clubs.

lot  of  places  are  closing the  marinas  and  now i guess the  state is   because  marinas  draw  people from all over  look at lake  ontario you get  people  from  nyc  jersey  down state pa ...you  want  a  hot  spot   in your town? look  at  charter  boats  how  are  you  going to take  people  out  fishing and   everyone  socially distance????

Unfortunately, I don’t know what to tell you. On Thursday, we (DEC staff) were counseling anglers and boaters that the revised Executive Order was not intended for DEC boat launch sites as DEC’s sites are self-serve, they are not businesses, etc., and then Friday led to more confusion as DEC was discussing gating off launch sites where there are gates. DEC is trying to get some clarity to all this, and DEC was working with OPRHP (New York Parks) to try to develop guidance that could be shared.  Nothing yet.

 

That said, I do not believe that there is going to be any hard enforcement of no use of state launches, likely enforcement discretion – at least the first time. 

 

I have been contacted by quite a few people (as have other DEC staff) and there were hundreds of calls to DEC offices on Friday. Hopefully, we will receive guidance and clear direction soon.  As soon as I know more, I will let you know.
